1. Who we are

The website artcontests.info (the “Website”) is operated by Simonitto ltd., with registered office at ul. Serdika 23, 1202, Sofia, Bulgaria, EIK 207284384 (the “Operator”). Contact: info@artcontests.info – Privacy: privacy@artcontests.info.

2. Definitions

• User: anyone browsing or using the Website.
• Call / Opportunity: listings published on the Website (competitions, open calls, residencies, grants, awards, etc.).
• Content: text, images, links, dates and any material submitted or published on the Website.
• Services: browsing Calls, search/filter/sorting features, and submitting Calls via Website forms.

3. Scope of the Service

The Website provides a directory and publication service for Calls, including search, filters and sorting features. The Operator may offer free and/or paid publishing options, as indicated on the Website and/or within the forms.

4. Acceptable use

Users agree to:

• use the Website lawfully and in good faith;
• not disrupt the Website’s security or operation;
• not submit unlawful, defamatory, misleading, discriminatory or infringing content;
• not use automated tools to extract data (scraping) without written permission.

5. Submitting and publishing a Call

Users may submit Calls via Website forms. By submitting a Call, the User represents and warrants that:

• all information provided is accurate, up to date and not misleading (title, description, dates, awards, requirements, links, etc.);
• they hold the necessary rights to any submitted text/images, or have permission to use and publish them;
• the submission does not violate third-party rights (IP, privacy, etc.);
• any third-party personal data included (e.g., organizer contacts) is provided in compliance with applicable laws.

5.1 Moderation, edits and removal

The Operator may, at its sole discretion:

• review, reject, suspend, edit (including formatting/layout) or remove any submitted Call;
• request clarifications or supporting evidence;
• fix obvious errors (typos, broken links, formatting).

5.2 License to use submitted Content

By submitting Content, the User grants the Operator a non-exclusive, worldwide, royalty-free license to publish, reproduce, display, communicate to the public, adapt (for editorial/layout purposes), translate (where applicable), and promote the Call on the Website and the Operator’s channels (e.g., social media, newsletters, previews), for as long as necessary to provide the service and/or maintain the Calls archive.

5.3 Languages and translations

The Website may allow Users to choose how to publish in Italian and/or English (single language, user-provided translation, or automatic translation). The User understands that:

• automatic translation may involve third-party AI/translation providers;
• automatic translation may contain inaccuracies; the User remains responsible for the material accuracy of published information.

6. Fees, payments and refunds (if applicable)

Some publishing options/features may be subject to a fee. Prices and conditions are displayed on the Website and/or within the submission form at the time of selection. Payments may be processed by third-party providers (e.g., Stripe/PayPal). The Operator does not store full card details. Unless required by mandatory law or otherwise stated, digital publishing services already delivered (e.g., a Call already published) may be non-refundable. Any refunds (if granted) are assessed case by case.

7. Expiry, archiving and expired Calls

Calls may include a deadline. After expiry, a Call may be removed, archived or made non-visible (including automatically) without notice.

8. Third-party links

Calls may contain links to third-party websites. The Operator does not control third-party sites and is not responsible for their content or practices. Users should always verify details on the organizer’s official sources.

9. Limitation of liability

To the fullest extent permitted by applicable law, the Operator is not liable for:

• inaccurate or outdated information in published Calls;
• changes/cancellations by organizers;
• indirect damages, loss of chance, data loss, or lost profits.

10. Indemnity

The User agrees to indemnify and hold harmless the Operator from third-party claims arising from the User’s submitted Content, including IP infringement or misleading information.

11. Changes to these Terms

The Operator may update these Terms at any time. Changes are effective upon publication on the Website.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Bulgaria. Unless mandatory rules provide otherwise, the competent courts are those of Sofia (Bulgaria).
